Description

A hearing may involve many different types of testimony, including opinion testimony; however, opinion testimony is disfavored and, as a result, is given special treatment. Still, opinion testimony may be necessary, admissible, and helpful to the trier of fact. There are strict limitations on lay witness testimony. Experts are given more latitude in expressing opinions but must meet certainly preliminary requirements. This class will review the rules for admitting both lay and expert opinions how these two types of opinions are treated in the context of an administrative hearing.
