How does an ALJ follow the Executive branch’s order, impacting Title IX, without infringing on civil rights? The reach of the Executive Order 14168 is vast, but it is not all-encompassing. The Order impacts mandatory terminology in adjudications, orders and reports, identification and references to gender and gender identity, and has spurred related policy changes and requirements. The Office of Personnel Management, the EEOC, the Department of State, and other agencies have also set forth policies and guidance on these questions, which will be presented and discussed. By conference time, SCOTUS will have handed down all its decisions from the 2025-2026 term, which will likely provide additional solutions to this challenging problem.
