Description

Probable cause (or reasonable grounds) is an issue in driver’s license suspension hearings involving DUI and/or implied consent. Standardized field sobriety tests (SFSTs) are an important part of the totality of the circumstances. This presentation will help hearing officers determine admissibility and the evidentiary weight to be given to SFST testimony. The importance of performing the tests correctly and the ability to articulate SFST results will be discussed, including the distinction between expert testimony and the observations of the officer who administered the SFSTs. This session will explore the proper role SFSTs play in determining the issues at the administrative hearing.
