Description

Driving privileges can be suspended in an administrative hearing even when evidence is insufficient to show when or if an individual was driving. Being in “actual physical control” (APC) of a vehicle under the influence of intoxicants has consequences akin to driving under the influence. This session will explain the concept as it is applied in administrative hearings regarding driving privileges. The elements of APC will be explained and scenarios from actual cases will be used in discussing when a situation may or may not satisfy those elements as they relate to the findings and conclusions needed to decide such cases.
