Description

This class will do a post-mortem on the Chevron doctrine, will dissect Loper Bright Enterprises v. Raimondo and Relentless, Inc. v. Department of Commerce and will describe and discuss where administrative agencies are now, with regard to deference or the lack thereof. The impact of these cases, if any, on view of the various state administrative agencies regarding deference will also be discussed. Other recent SCOTUS cases which are likely to have an influence on administrative adjudication, such as Jarkesy I and Jarkesy II, will also be discussed, including “next steps” for administrative law judges and other hearing officials.
