Hearings regarding a nursing facility’s desire to discharge a patient who does not wish to be discharged can be demanding. There is a high turnover among nursing facility administrators, and they rarely understand the hearing process. An important factor in these hearings is whether the Notice to Discharge was legally and factually adequate. These hearings can, understandably, become heated at times.
