Ensuring a hearing will be fair begins before the hearing with parties’ ability to conduct discovery of evidence relevant to the issues. This session introduces the concept of “discovery” in administrative hearings, including discovery purposes and methods. Tips on handling discovery in proceedings with self-represented participants will be provided, including the use of clear pre-hearing orders and options available when discovery doesn’t go as intended. This discussion will be beneficial to both new and experienced adjudicators.
