Name
12A Walking the Line: Self-Represented Litigants in Administrative Hearings (M)
Description
Most appellants in administrative hearings appear without counsel, creating problems for hearing officials: How do you help someone navigate the system without becoming their advocate? When does clarifying a question cross the line into coaching? How much explanation is too much? This session addresses the challenges and ethical considerations of presiding over hearings with self-represented litigants and explores balancing fairness with neutrality, ensuring due process without providing legal advice, and creating a hearing environment where self-represented individuals, including difficult litigants, can effectively present their cases.
